The Directors Guild of America – Producer Pension and Health Plans (the “Plans” “us” or “we”) is concerned with your privacy when you visit this website, including the myPHP Portal (the “Portal”) subdomain of the website (collectively, this “Website”), just as we are concerned with your privacy in all of your dealings with the Plans. While visiting this website or otherwise dealing with us, you may have the opportunity to volunteer personal information. We consider any information which relates to your participation in the Plans as “personal information.” Information which does not identify you, or does not relate to your participation in the Plans is not “personal information” and is not covered by this website privacy policy. For purposes of clarification, the “Plans” includes the Directors Guild of America – Producer Health Plan (the “Health Plan”) and Directors Guild of America – Producer Pension Plans.

If you choose to communicate with us or our authorized vendors by e-mail, text or through this website or the websites of such authorized vendors, or you choose to register and maintain an on-line account with us on the Portal (an “Account”), we will need information from you, such as your name, physical street and/or mailing address, e-mail address, phone number, social security number, date of birth, Plan identification number, enrollment information, claims information or other personal information, in order to answer your questions and communicate with you, to provide you with Account access, and/or to provide you with information, services or materials requested by or available to you, including, without limitation, enrollment and benefits related services, offers and opportunities.

Except as set forth in this privacy policy (or, with respect to the Health Plan, in the Health Plan’s HIPAA Notice of Privacy Practices), or as otherwise authorized by you, we will not disclose your personal information collected by us as outlined above, unless it is necessary: (i) for the administration and business operations of the Plans (including the Plans’ payment activities and healthcare operations); (ii) the operation, maintenance or security of this website or your Account; (iii) to respond to your inquiries; (iv) to provide you with your applicable benefits or other services or materials requested by you, or information related to other opportunities that may be useful to you (including opportunities offered by the business partners, business associates and vendors of the Plans); or (v) to inform you of such benefits, services and opportunities. Notwithstanding the foregoing, we may disclose your contact and demographic information to the union and contributing employers for their internal administrative purposes to the extent permitted by applicable law.

We may also access and disclose your personal information, any communications sent or received by you, and any other information that we may have about you: (a) as may be permitted or required by law, regulation, rule or court order; (b) pursuant to requests from governmental, regulatory or administrative agencies or law enforcement authorities; (c) to prevent, investigate, or take any other lawful action regarding suspected fraud, violations of the website’s Terms of Use, potential threats to the physical safety of any person, or other activity that we believe to be illegal or may expose us and/or the Plans to legal liability; (d) to our lawyers, accountants, tax consultants and employees for the purpose of conducting our business and providing you with information; or (e) in the event of a merger of one or more of the Plans with another benefit plan or the termination of a Plans and transition of the Plans’ participants to a successor plan.

Because the Plans and a number of the service providers we use are located in the United States, your personal information will be processed and stored inside the United States, and the United States government, courts, or law enforcement or regulatory agencies may be able to obtain disclosure of your personal information under United States laws.

Review of Account Information. We offer you the ability to review and change/update your Account registration, verification and contact information by logging into your Account and entering in the new information yourself or by contacting us at (323) 866-2200 or toll-free at (877) 866-2200. You must promptly update such information if it changes or is inaccurate.

Health Information. The use of your “protected health information” (as such term is defined by the Health Insurance Portability and Accountability Act of 1996 and the regulations issued thereunder (“HIPAA”)) by the Health Plan and the Health Plan’s providers is subject to the Health Plan’s HIPAA Notice of Privacy Practices.

Security Safeguards. The Plans have implemented reasonable safeguards appropriate to the sensitivity of the personal information we maintain. Safeguards will vary depending on the sensitivity, format, location, amount, distribution and storage of the personal information. They include physical, technical and managerial measures to keep personal information protected from unauthorized access. Note that due to the nature of the internet and related technology, we cannot absolutely guarantee the security of personal information disclosed over the internet, and the Plans expressly disclaim any such obligation.

Modifications to Privacy Policy. We reserve the right to change this website’s privacy policy from time to time. If we make any substantial changes in the way we use your personal information, we will notify you by posting a prominent announcement on this website. This privacy policy is not intended to and do not confer upon you any contractual or other legal rights in respect to the Plans or any other party.

Children’s Privacy. We recognize the importance of protecting the privacy of children, and this website is not intended for use by children. For this reason, we do not knowingly collect personally-identifiable information from children under the age of 13.

Third-Party Websites. Third-party websites linked to on this website operate under different privacy practices and policies which are not under our control. We are not responsible for the privacy practices of such websites or their operators. If you decide to access any such third-party websites, the Plans encourage you to review the privacy policies and terms of use of such third-party websites.

NOTICE TO CALIFORNIA RESIDENTS – YOUR CALIFORNIA PRIVACY RIGHTS

California Civil Code Section 1798.83 requires any operator of a website to permit its California-resident customers to request and obtain from the operator a list of what personal information the operator disclosed to third parties for direct marketing purposes, for the preceding calendar year; and the addresses and names of such third parties. The Plans Office does not share any personal information collected from this site with third parties for their direct marketing purposes.
