The DGA–Producer Pension Plans

Benefits Overview

There are two pension plans: the Basic Pension Plan and the Supplemental Pension Plan.

The Basic Plan

The Supplemental Plan

  • a Defined Benefit Plan
  • provides a fixed benefit that is defined by a formula based on your years of service (Credited Service Months) and your Career Average Earnings.
  • a Defined Contribution Plan
  • provides a benefit based on the amount of contributions and investment returns credited to your account

The Basic Plan

How the Basic Plan is Funded

When you work for a DGA-signatory employer, for the first $20,000 in reportable earnings, your employer makes pension contributions to the Basic Plan equal to 8.5% of those earnings. On reportable earnings from $20,001 up to $150,000, your employer makes pension contributions to the Basic Plan equal to 6.3% of those earnings.

In accordance with DGA Collective Bargaining Agreements, the Basic Plan also receives contributions that result from the release of films to television and supplemental markets.

Qualifying for Basic Plan Benefits

To qualify for benefits, you must be vested. There are three ways to become vested:

Ten-year Vesting

A participant is ten-year vested if he or she has accrued at least 120 Credited Service Months (CSMs), which is also known as ten-year vesting. You can accrue a maximum of 12 CSMs in a calendar year. Beginning January 1, 2022, you must earn at least $45,600 in DGA Covered Employment (or 1 CSM for each $3,800) to obtain 12 CSMs; this amount is indexed periodically. For example, if you earn $45,600 in a calendar year, you accrue 12 CSMs; if you earn $8,500, you accrue 2 CSMs.

Full benefits are payable at age 65, but reduced benefits can begin as early as age 55.

Five-year Vesting

A participant may become five-year vested with as few as five years of employment. Generally, you become vested under the five-year vesting rules upon attaining five Plan Credit Years, which means you have sufficient earnings to accrue 12 CSMs in one year for five years without having a Permanent Break in Service. A Plan Credit Year is a Plan Year in which a participant earns 12 Credited Service Months. A Permanent Break in Service occurs when a participant earns a Plan Credit Year and, prior to earning another Plan Credit Year, the number of Break in Service Years (or years in which the participant does not earn at least seven CSMs or work at least 51 days in Covered Employment):

  • is greater than four, and
  • equals or exceeds the number of his or her Plan Credit Years.

You must also have sufficient DGA Covered Earnings in 1999 or later years to qualify for five-year vesting. Pension benefits for participants who are five-year vested are payable at age 65.

Anniversary Vesting

A participant who has not vested under ten- or five-year vesting, may become anniversary vested if he or she:

  • has attained age 65,
  • has had 5 years participation in the Basic Plan, without taking into account participation preceding a permanent Break in Service, and
  • has earned compensation or a Plan Credit Year after satisfying the above requirements.

Calculating Your Basic Plan Benefit
NOTE FOR MEMBERS WHO COMMENCED PARTICIPATING ON OR AFTER JANUARY 1, 2020
If your initial date of participation in the Basic Plan is on or after January 1, 2020, your Basic Plan benefit amount as determined below is subject to the accrual rates described here.

The Basic Plan is designed to pay you a monthly benefit beginning at age 65.

Your actual benefit depends on:

  • your Career Average Earnings (which is based on your salary or earnings in DGA Covered Employment and the number of years that you worked). Career Average Earnings are calculated by taking your Covered Earnings up to $150,000 in each year after 1960 during which at least one CSM was earned, divided by your total CSMs, then multiplied by 12;
  • your CSMs earned;
  • your age;
  • the date you commenced participating in the Basic Plan; and
  • the option or form of payment you elect.

For example, if you worked a total of 13 years (156 CSMs) with the following work history:

$845,000 ÷ 156 = $5,416.67

$5,415.67 x 12 = $65,000; $65,000 is your Career Average Earnings

Next, the Plan’s benefit formula is applied to your Career Average Earnings to produce your age 65 benefit. Specifically, the benefit formula is:

Career Average Earnings Annual Benefit for Each Year of Service
$0-$19,999 3.6% of Earnings
$20,000-$49,999 $720 plus 2.5% of excess over $20,000
$50,000-$99,999 $1,470 plus 1.8% of excess over $50,000
$100,000-$150,000 $2,370 plus 1.2% of excess over $100,000

Then, multiply the resulting amount by the number of years of service (CSMs earned divided by 12). The resulting annual amount cannot exceed $66,000, or $5,500 per month.

For example, using the above Career Average Earnings of $65,000 and 156 CSMs (13 years), your monthly benefit would be $1,885, calculated as follows:

Step 1 $1,470 + $270 (1.8% of $15,000) = $1,740 Annual benefit per year of service
Step 2 $1,740 x 13 years of service = $22,620 Annual benefit at age 65
Step 3 $22,620 ÷ 12 = $1,885 Monthly benefit at age 65

At age 65, the monthly benefit of $1,885 would be payable to you for your lifetime. If you have at least 120 CSMs, you may choose to receive benefits as early as age 55, but the monthly amount is reduced to account for a longer benefit pay-out period. Under certain circumstances, you may elect to have a reduced benefit payable over your lifetime with benefits continuing for the life of your spouse or other beneficiary. A lump sum option is also available for participants with at least 120 CSMs (at least one of which must have been earned prior to January 1, 1999) with benefits commencing at age 60 or older. If you are eligible for the lump sum option, the lump sum portion will be based on the lesser of $3,450 or the amount of your accrued benefit as of December 31, 2002; any benefit accrued on or after January 1, 2003, will be paid as a monthly benefit.

NOTE FOR MEMBERS WHO WERE PARTICIPANTS PRIOR TO JANUARY 1, 1994
If your benefit is greater under the prior plan that calculated benefits based on your Credited Service Months without regard to earnings, you will receive the higher amount.
Your Basic Plan Payment Options

When you are ready to commence your benefit, the following payment options will be available to you:

  • Single Life Annuity. This is a normal payment option for an unmarried participant. Benefits are paid on a monthly basis for the lifetime of the participant with no benefits payable after death.
  • Participant and Partner Pension. This is a normal payment option for participants with spouses. Monthly benefits will be received for your lifetime, but if your spouse outlives you, they will continue to receive 50% of the monthly benefit paid to you at the time of your death.
  • Joint & Survivor Annuity (50%, 75% or 100%). These forms of benefit provide a monthly benefit for your lifetime, and your co-annuitant will receive a benefit equal to 50%, 75% or 100% of the monthly benefit paid to you at the time of your death.
  • 10-Year Certain Life Annuity. This form of benefit provides a monthly benefit for 120 payments or your lifetime, whichever is longer. If at least 120 payments have not been received at the time of death, then the balance of the 120 guaranteed payments is made to the designated beneficiary(ies) in monthly payments.
  • Immediate Lump Sum. If you are eligible, you may choose to receive your Basic Plan benefit as an immediate lump sum. This amount will be determined based on the single life annuity amount as of December 31, 2002; any excess benefit accrued since then will be paid as a monthly benefit.
  • Deferred Lump Sum. If a participant meets all of the requirements for the immediate lump sum payment option, except he or she is under age 65 and has not ceased DGA-covered employment in the six months prior to commencement of benefits, he or she is eligible for the Deferred Lump Sum payment option. The amount payable under the immediate lump sum payment option is calculated at the time of the participant’s benefit commencement date (using the lump sum factor in effect) and a monthly installment benefit is paid until the participant reaches age 65.

The Supplemental Plan

How the Supplemental Plan is Funded

Supplemental Plan contributions made on your behalf are deposited into your own individual account. After your first $20,000 in DGA-covered earnings, your employer makes pension contributions equal to 2.2% of your earnings up to $150,000 and 8.5% of earnings over $150,000 to the Supplemental Plan.

The Supplemental Plan also receives contributions directly from you as a Plan participant, where 2.5% of your reportable earnings is deducted by your employer from your check and submitted with the employer contributions. This amount is credited to your Individual Account.

You can also roll over funds from your other qualified retirement accounts into your Supplemental Plan account and take advantage of the Supplemental Plan’s diversified investment portfolio and solid investment performance record.

Qualifying for Supplemental Plan Benefits

To qualify for benefits, you must have an account balance in your Individual Account and be at least age 60. Participants who become disabled (as defined by the Plan) are entitled to benefits regardless of age. If you have not accrued at least 36 CSMs, you may be eligible to withdraw the portion of your account related to your employee contributions and related investment gains or losses; however, you will be forfeiting the portion related to your employer contributions and related investment gains or losses.

The full account balance is available to your beneficiary(ies) upon your death.

Calculating Your Supplemental Plan Benefit

The amount in your Individual Account is your benefit. Your account balance is invested with the account balances of all other participants. Our independent investment managers invest the funds in a variety of sound vehicles such as stocks, bonds, real estate, certificates of deposit, etc. Each month, the investment return is calculated and your account is credited with a portion of the investment gains or losses.

Your Supplemental Plan Payment Options

When you are ready to commence your benefits, you will have the following payment options available to you:

  • Partial Distributions. This form of benefit provides payments either on an as-needed basis (a minimum distribution of $5,000, no more than one per calendar quarter) or as a set amount paid monthly (minimum $2,000), quarterly (minimum $5,000) or semi-annually (minimum $5,000).
  • Lump Sum. This form of benefit will be equal to the amount in your individual account as of the most recent valuation date.
  • Lump Sum/Annuity Combination. This form of benefit provides a portion of the benefit to the participant as a lump sum and uses another portion to purchase one of the annuity options below.
  • Single Life Annuity. This form of benefit provides a monthly benefit for your lifetime, with no benefits payable after death.
  • 10-Year Certain Life Annuity. This form of benefit provides a monthly benefit for 120 payments or your lifetime, whichever is longer. If at least 120 payments have not been received at the time of death, then the balance of the 120 guaranteed payments is made to the designated beneficiary(ies) in monthly payments.
  • Joint & Survivor Annuity (50%, 75% or 100%). These forms of benefit provide a monthly benefit for your lifetime, and a benefit equal to 50%, 75% or 100% of your monthly benefit for the lifetime of the co-annuitant following your death.
  • Single Life Annuity, Joint & Survivor (50%, 75%, or 100%) with Cash Refund. When a payment option with a Cash Refund is selected, the amount used to purchase the annuity, less the total amount of monthly payments received, is paid in a lump sum to a designated beneficiary following the death of the participant.
  • Qualified Longevity Annuity Contract (QLAC). This deferred annuity product provides a monthly benefit that starts later in life, which translates into higher monthly benefit payments once they begin. The portion of your Supplemental Plan account balance used to purchase a QLAC will be excluded from the account balance used to determine your Required Minimum Distribution once you reach your Required Beginning Date.

Any payment option that includes an annuity will use that portion of your account to purchase an annuity from a third-party company. From that point forward, the annuitized benefits are the responsibility of the third-party company.

Check Your Quarterly and Annual Statements

It is very important for you to check that contributions are being paid into the Plans. The Plans send quarterly statements to each participant who had reported earnings during the quarter. The statement shows the contributions made on your behalf by each of your employers.

The Plans also send all participants an annual statement showing earnings and Credited Service Months accrued as well as pension benefits you may be entitled to.

If your records differ from ours, contact the Contributions Department at (877) 866-2200 ext. 567 as soon as possible so that we can pursue collection on your behalf. Non-receipt of contributions can jeopardize your pension benefits!

For purposes of clarity, the Plans’ provisions have been summarized. We emphasize that nothing in this explanation is intended to change the provisions of the Plans and that only the Board of Trustees is authorized to interpret the Plans. In the event any question is raised, the rights of participants will be determined in accordance with applicable Plans language and by the rules and regulations adopted by the Board of Trustees in the course of the administration of the Plans. The Board of Trustees reserves the right to interpret, alter or amend the Plans. Updated copies of the full Plans documents are available to participants and beneficiaries from the Plans Office.

Created as a result of the Directors Guild of America's collective bargaining agreements with producer associations representing the motion picture, television and commercial production industries, the DGA-Producer Pension and Health Plans provide excellent benefits to participants.

The DGA-Producer Pension and Health Plans are separate entities from the DGA and are administered by a Board of Trustees made up of DGA representatives and Producers' representatives.
